Özet

Off-shore bankalara para yatıran kimselerin bu tasarrufu, devlet güvencesinde değildir. Off-shore’un sigorta kapsamında devlet tarafından ödenmesine ilişkin kanuni bir düzenleme de bulunmamaktadır. Sigortacılık kapsamındaki mevduat, Bankacılık Kanunu md. 3 ve md. 64 hükümlerinde açıkça sayılmıştır. Fon Kurulu’nun, devir ve tasfiyesi amacıyla Tasarruf Mevduatı Sigorta Fonu’na intikal ettirilen bankalara ilişkin yapacağı protokol/sözleşme/taahhüt gibi hukuki işlemler Bankacılık Kanunu’nun tanıdığı yetki, hak ve sorumluluk kapsamındadır. Bankacılık Kanunu’nun emredici hükümlerini bertaraf eden ve kapsam dışı kalan hukuki işlemler Borçlar Kanunu gereğince yok hükmündedir. Talimatları olmadığı halde, parası muhabir bankaca off-shore bankasına gönderilen ve gönderilmiş gibi gösterilen kimseler, muhabir bankanın mudisi ve o banka da Türk Bankacılık Sistemine tabi olduğu için zararı devletçe tazmin edilmelidir. Off-shore bankalarda talimatlı hesap açtıranlar ise yüksek faiz getirisi, vergi muafiyeti ile bilerek ve isteyerek tasarrufta bulunarak, denetim ve kontrol dışına çıkmış kimselerdir. Bu tasarrufları neticesinde gerçekleşecek riskten kendileri sorumludurlar ve devletin talimatları ile havale işlemini gerçekleştiren kimselere karşı tazmin yükümlülüğü bulunmamaktadır.
Deposits made in off-shore banks do not benefit from state guarantee. There is no legal regulation providing that the state shall pay the off-shore as part of insurance. The deposits covered in insurance are clearly stated in Banking Law articles 3 and 64. Legal transactions of the Fund Board, such as protocoles/agreements/affidavits regarding the banks which are transferred to the Savings Deposit and Insurance Fund for their acquisition and liquidation, are regulated within the scope of the authority, rights and responsibility provided under the Banking Law. As per the Turkish Code of Obligations, all legal transactions which eliminate or conflict with the imperative provisions of the Banking Law are declared null and void. Since the depositor of the corresponding bank and the corresponding bank itself are subject to the Turkish Banking System, damages caused by the fact that the deposits are transferred or shown as transferred to the off-shore bank via corresponding bank without any order from the depositor, should be compensated by the state, People who open deposit accounts with order in off-shore banks fall out of the control and supervision as they willingly dispose with high interest return and fiscal immunity. They are responsible for the risks caused by their savings and the state is not obliged to compensate for the depositors who make transfers with order.
