Özet
Çalışmamızda öncelikle 2019/1152 sayılı Yönerge hakkında genel bilgiler verildikten sonra, Yönerge’de yer alan başka işte çalışmaya ilişkin hüküm ayrıntılı olarak incelenecektir. Belirtmek gerekir ki Yönerge’de yer alan bu hüküm işçinin aynı zamanda birden fazla işverenle iş ilişkisinde bulunması ile ilgili olup; işçinin çalışma saatleri dışında hobi amaçlı, gönüllük esasına dayalı ya da iş sözleşmesi dışında diğer iş görme sözleşmeleriyle çalışmalarını kapsamamaktadır. Konuya ilişkin açık-lamalarımız hukukumuz bakımından da bu kapsamla sınırlanmıştır. Ça-lışmamızda, Türk hukukunda başka işte çalışmanın sınırları ve bu konuda sözleşmelere getirilebilecek hükümler incelenerek Yönerge kapsa¬mında değerlendirilmiştir.
In our study, firstly, after giving general information about the Directive No. 2019/1152, the provision regarding the employee working with other employers in the Directive will be examined in detail. It should be noted that this provision in the Directive is a regulation regarding the employee to have a business relationship with more than one employer at the same time; it does not cover the worker's work outside of working hours for hobby purposes, on a voluntary basis or with other contracts for works and services other than employment contracts. In this respect, the explanations on the subject are limited to this scope in terms of our law. In our study, the limits of working in another job in Turkish law and the provisions that can be brought to the contracts on this subject are examined and evaluated within the scope of the Directive.
